- disrupt, interfere with, or attempt to disrupt or interfere with the Site, its infrastructure, or its security;
- copy, scrape, harvest, or reproduce the Site in bulk using automated tools, crawlers, bots, or similar means;
- misuse the contact form, subscription form, or any other communication channel;
- use the Site for any unlawful purpose, or in breach of any applicable law or regulation;
- attempt to gain unauthorised access to any part of the Site or its systems;

- frame, mirror, or otherwise incorporate the Site or any part of it into another website without our prior written consent.
We reserve the right to restrict, suspend, or terminate your access to the Site at any time, without notice, if we reasonably believe these Terms have been breached.
5. Errors and Omissions Excepted (E&OE)
All information on the Site, and all information provided in any Quotation or communication, is provided errors and omissions excepted (E&OE).
This Clause governs all information displayed on the Site, all Quotations, and all other communications we make in connection with the Products and Services. It defines and applies the principle of errors and omissions excepted (E&OE), in all instances, without limitation.
5.1 Scope of application
All information on the Site, and all information provided by us in any Quotation or communication — whether through the Site, by email, by WhatsApp, by telephone, or in person — is provided errors and omissions excepted (E&OE). This applies without limitation to:
- ingredients, allergens, flavour descriptions and product composition;
- colours, tones, finishes, decorative elements and design illustrations;
- photographs, images, renders and illustrations;
- sizes, weights, portion yields and dimensions;
- stock levels, availability, lead times and delivery times; and
- prices, price indications and Quotations.
5.2 No warranty of accuracy
We take reasonable care to ensure the accuracy of the information we publish. However, given the volume and nature of that information, errors, inaccuracies and omissions may occur. We do not warrant that any information on the Site, or in any Quotation or communication, is accurate, complete, current, or free from error.
We reserve the right to correct any error, inaccuracy or omission at any time, without notice, and without liability.
5.3 Verification by you
You must not rely on any information on the Site, or in any Quotation or communication, as the sole basis for any decision to purchase, consume, serve, or use any Product or Service. You must verify all material information with us in writing before placing an order.
5.4 No contract until written confirmation
No contract of sale comes into existence until we have confirmed the order in writing. Until we issue a written order confirmation, no price, quotation, image, specification, indication of availability, or other information is binding on us, and we may decline or cancel any enquiry or order at our discretion in accordance with Clause 7.5.
5.5 Quotation validity
A Quotation is valid for the period stated in it, or if no period is stated, for seven (7) calendar days from the date of issue. After that period, the Quotation lapses and a fresh Quotation must be requested.
A Quotation is subject to the availability of stock and to any change in the cost of ingredients, packaging, transport, labour, duties, taxes, exchange rates, or other input costs between the date of the Quotation and the date of order confirmation.
5.6 Information supplied by you
Where a Quotation, order confirmation or any other communication is based on quantities, specifications, dates, event details, or other information supplied by you, we rely on that information in good faith. We are not responsible for any error, inaccuracy or omission in information supplied by you, and any resulting Quotation or order confirmation will be adjusted accordingly.
Where a Quotation is expressed to be an estimate, it is an estimate only. Final pricing will be confirmed on and at the time of order.
5.7 Variation in jello products
Jello cakes and jello art are hand-made. No two pieces are ever exactly identical. Images are for illustrative purposes only, screens vary, and the appearance of a Product in a photograph or on a screen may differ from the physical Product. You must confirm your design, colours and decorative elements with us in writing before placing an order.
Colour, tone, translucency, set, pattern, decoration and finish may vary between batches. Such variation is inherent in the hand-made and perishable nature of the Product and does not constitute a defect.
5.8 Reporting errors
If you become aware of any error or omission on the Site, please notify us at legal@jigglz.co.za so that we can inspect same and attend to a correction if necessary. Our inspection of any reported error, omission or defect, whether on the Site or in respect of any Product, is not an admission of liability.
6. Products, ingredients and allergens
Our Products are food items. By placing an order, you acknowledge and agree that:
6.1 Ingredients and allergens
Our jello cakes and jello art may contain, or may have been prepared in a kitchen that handles, one or more of the following: gelatine (or a vegetarian substitute), water, sugar, flavouring, colourants, citric acid, dairy, eggs, gluten, soy, nuts and other tree nuts. You are responsible for checking the ingredient and allergen information of any Product before ordering, and for informing us of any allergy or dietary requirement at the time of ordering. We cannot guarantee that any Product is free from a particular allergen.
6.2 Refrigeration and perishability
Jello products are perishable. Unless otherwise stated in writing, Products must be refrigerated at all times after collection or delivery, must be consumed within the period stated on the packaging or order confirmation, and must not be exposed to direct heat or sunlight. We are not liable for any loss, spoilage, illness or damage arising from failure to observe storage, handling or consumption instructions after delivery.
6.3 Colours and decorations
Colours and decorative elements may vary from photographs and from previous orders. Where a specific colour match is critical, you must request and approve a sample or photograph in writing before the order is confirmed.
6.4 Bespoke and custom products
Bespoke, custom-designed, personalised and cut-to-size Products are made specifically for you and cannot be resold. You must satisfy yourself as to design, colours, allergens, size and quantity before the order is confirmed.
7. Quotations, prices, taxes and payment
This Clause deals with the commercial terms of quotations and payment. It operates together with, and is subject to, Clause 5 (E&OE).
7.1 Prices are provided on request
The Site may not display prices. Prices are provided upon request. A request for pricing is not an order, and no contract is formed by the provision of a price or Quotation.
7.2 Taxes, duties and additional costs
Unless expressly stated otherwise in writing, all prices and Quotations are exclusive of:
- value-added tax (VAT) and any other applicable taxes;
- delivery, packaging, transport and courier costs;
- custom design, decoration, topper or personalisation fees; and
- any permit, licence, or regulatory fee.
Such amounts are payable by you in addition to the price, unless expressly agreed otherwise in writing.
7.3 Currency and payment
Unless otherwise agreed in writing, all prices are quoted in South African Rand (ZAR). Payment must be made by the method and within the period stated in the order confirmation. Where payment is made in a different currency, any exchange loss, bank charge, or conversion cost is for your account.
We reserve the right to require a deposit or full prepayment before preparing or dispatching any order. Where payment is not made by the due date, we reserve the right to:
- suspend or cancel the order, without liability;
- charge interest on the overdue amount at the rate stated in the order confirmation, or if no rate is stated, at a reasonable commercial rate; and
- recover all costs of enforcement, including legal costs on the attorney-and-client scale.
7.4 Variation of orders
Any variation to an order must be agreed by us in writing. We reserve the right to charge for any variation, and to adjust delivery times and preparation times accordingly.
7.5 Right to decline or cancel
We reserve the right, at our discretion, to decline any enquiry, request or order, and to cancel any order (with a full refund of any amount paid in respect of it) where:
- the Product is no longer available;
- a material error or omission has occurred in the Quotation or order confirmation;
- the price would need to be adjusted due to a change in input costs;
- the requested design or dietary requirement cannot reasonably be accommodated;
- we are unable to verify your identity, authority, or ability to pay;
- we are required to do so by law or by a competent authority.
8. Stock, availability, delivery and collection
Stock levels, preparation times and delivery times displayed on the Site, or provided in any Quotation or correspondence, are indicative only and are subject to Clause 5 (E&OE). They do not constitute a guarantee of availability or of any particular delivery date.
Delivery and preparation times may be affected by factors beyond our reasonable control, including ingredient shortages, supplier delays, transport disruptions, load-shedding, adverse weather and force majeure events as described in Clause 16. We will use reasonable endeavours to keep you informed of any material delay, but we are not liable for any delay or for any loss arising from it, except as required by law.
8.1 Delivery, risk and title
Unless otherwise agreed in writing:
- Delivery is complete when the Products are handed over at the delivery address stated in the order confirmation, or collected by you or your representative.
- Risk in the Products passes to you on delivery or collection.
- Title in the Products passes to you only upon receipt by us of payment in full, in cleared funds, of the price and all other amounts due.
- You must inspect the Products on delivery or collection and notify us in writing of any shortage, damage, defect or incorrect item within four (4) hours of delivery or collection. If you do not, the Products will be deemed to have been accepted, save in respect of any latent defect that could not reasonably have been discovered on inspection.
8.2 Storage after delivery
You are responsible for the correct storage and handling of the Products after delivery or collection. See Clause 6.2. We are not liable for any loss, spoilage, illness or damage arising from incorrect storage, handling or use of the Products after delivery.
9. Orders and formation of contract
An order is formed only when we issue a written order confirmation. The order confirmation, together with these Terms and any written Quotation expressly incorporated into it, constitutes the entire agreement between us in respect of that order.
10. Cancellation and returns
10.1 Cancellation by you
Once an order has been confirmed in writing, it may not be cancelled by you without our prior written consent. Where we agree to a cancellation, we reserve the right to charge:
- any costs already incurred by us, including ingredients, packaging, labour, transport, and supplier charges;
- a reasonable administration fee; and
- any amount required by our suppliers.
10.2 Returns
Because our Products are perishable food items, returns are accepted only where the Products are defective, or where we have delivered Products materially different from those confirmed in the order confirmation. In such cases, you must notify us in writing within four (4) hours of delivery or collection and provide photographic evidence. We will, at our election, replace or refund the affected Products. This Clause does not limit any right you may have under the CPA or any other applicable consumer protection law.
10.3 Bespoke and custom Products
Bespoke, custom-designed, personalised, cut-to-size and special-order Products are not returnable, save where they are defective on delivery. This is because such Products cannot be resold and are perishable. Please satisfy yourself as to design, colours, allergens, size and quantity before ordering.
11. Consumer rights
Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the CPA, ECTA, or any other mandatory consumer protection law of South Africa or of your country of residence, that cannot lawfully be excluded, restricted or modified.
Where you deal with us as a consumer, you may have the following rights under the CPA and other applicable law:

- the right to complain to the National Consumer Commission or the Consumer Goods and Services Ombud, where applicable.
Where you deal with us as a consumer and you are resident in the European Union, you may have a right of withdrawal within fourteen (14) days of delivery. This right does not apply to:
- goods made to your specifications or clearly personalised (including bespoke and custom-designed Products);
- goods that are liable to deteriorate or expire rapidly (including all jello Products); and
- goods that have been consumed, used, or altered after delivery.
To exercise any consumer right, contact us at legal@jigglz.co.za.

Nothing in this Clause limits any statutory warranty or right you may have under the CPA in respect of Products.
15. Limitation of liability
To the fullest extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, loss of revenue, loss of business, loss of opportunity, loss of data, or business interruption, arising out of or in connection with your use of the Site, any Quotation, any order, or any Product or Service, whether in contract, delict, statute or otherwise, and whether or not we have been advised of the possibility of such damages.
- Our total aggregate liability to you in respect of any order, or in respect of any use of the Site, shall not exceed the total amount actually paid by you to us in respect of that order.
- We shall not be liable for any loss or damage arising from any matter contemplated by Clause 5 (E&OE), save where the error, inaccuracy or omission in question was made fraudulently or with gross negligence.
- We shall not be liable for any illness, allergic reaction, injury or loss arising from your failure to observe the ingredient, allergen, storage, handling or consumption information provided with the Products (see Clause 6).
Nothing in this Clause limits or excludes any liability that cannot lawfully be limited or excluded under the CPA or any other applicable law.
16. Force majeure
We shall not be liable for any failure or delay in performing our obligations where that failure or delay is caused by an event beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, civil unrest, strikes, lockouts, government action, changes in law, load-shedding or other utility failure, failure of suppliers, failure of transport, cyber-attack, or any other event of similar nature.
Where a force majeure event occurs, we will notify you as soon as reasonably practicable, and our obligations will be suspended for the duration of the event. If the event continues for more than sixty (60) days, either party may terminate the affected order on written notice, in which case we will refund any amount paid by you in respect of Products not yet delivered, less any costs already incurred.
17. Indemnity
You agree to indemnify, defend and hold harmless Jigglez Jello Art (Pty) Ltd, its directors, officers, employees, agents and suppliers from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:
